Sources say the actress was offered a deal which included rehab and 90-days of house arrest. But she rejected the offer 'cuz she believes she should not have to face any penalties.
Lohan is accused of lying to police in Santa Monica after being involved in an accident last year.
Miley Cyrus stepped out on Thursday without her engagement ring for the second night in a row.
The 20-year-old claims to still be engaged to fiancé Liam Hemsworth, but she was also seen with a mystery man on her way to a house party in North Hollywood.

Kelly Osbourne could be suffering from epilepsy.
Osbourne suffered a seizure on the set of “Fashion Police” on Thursday and has been in the hospital since.
Doctors are running tests on her and they believe the seizure may be related to the brain condition.
She is expected to remain in the hospital for a few more days.
Jennifer Love Hewitt admitted that she's considered getting her breasts insured.
She said, "These things right here are worth $5 million! I need, like, an insurance invitation. If somebody was like 'Hey, you know what? We would like to insure your boobs for $2.5 million dollars,' I'd be like 'Do it. Love it! Why not?"
J-Love also mentioned her new role on the TV show, “Client List,” where she plays a high-profile prostitute.

A rep for a UFO research agency claims that Russell Crowe did not see an alien spaceship outside his Australia office, despite the video that he recently posted on the internet.
Crowe posted the time-lapse clip last week, claiming that he wanted to capture video of fruit bats, but recorded some eerie-looking flying lights instead.
The chief video analyst of the Mutual UFO Network said that the aircraft is likely a plane or a helicopter instead of being from another world.
He explained that the colors of the lights are like common aircrafts, and the other light patterns could have been caused by a lens flare.
Australian model and actress, Elle Macpherson, is engaged to the billionaire real estate developer Jeffrey Soffer.
They dated for two years before breaking up last March, and now the two are reportedly back together and engaged.
The source said Macpherson will move to Miami, where Soffer is based, to live with him.

It was a bad week for Justin Bieber. He got booed for being late to a show, had breathing issues mid-performance and fainted backstage.
Then to top it off, he came close to fighting with paparazzi.
One photog insulted him.
Biebs Tweeted: "Ahhhhh! Rough morning. Trying to feel better for this show tonight but let the paps get the best of me. Sometimes when people r shoving cameras in your face all day and yelling the worst thing possible at u, well I'm human. Rough week."
The fight happened just hours after Bieber said he was "getting better" from the breathing problems he suffered during the concert the night before. During that show, Justin took a short break to go backstage, got oxygen and had to be hospitalized for a check-up.
A spokeswoman for Justin said he was feeling "a little under the weather."

Justin was leaving the Central London Hotel when a waiting photographer got upset with Justin's bodyguards.
He started to yell insults, including: "F**k off. Go back to America f**king little moron."
That's when Justin opened the door of his SUV and yelled back: "What the f**k did you say?"
The paparazzo yelled back: "You heard what I f**king said!"
As Justin was being held back by his bodyguard he told the paparazzo: "I'll f**king beat the f**k out of you!"
Justin's security forced him back into the car and they took off.
Rihanna was forced to cancel her concert in Boston last night after getting laryngitis.
Live Nation postponed the show and released a statement that said: "Unfortunately, following her sold out concert on Friday, Rihanna has contracted laryngitis and per doctor's instruction is unable to perform this evening."
She is scheduled to play a show in Baltimore tomorrow. The Boston show will be rescheduled.
Justin Bieber has canceled one of his upcoming concerts in Portugal.
The concert’s promoter posted a message on their website that promised refunds to the fans.
It said, "Due to unforeseen circumstances, Justin Bieber was forced to cancel the second operation, in Portugal, on 12 March. The Canadian singer is eager to play for the Portuguese fans on 11 March."
The news of his canceled concert comes on the heels of a pretty bad week for the pop star.
The "Beauty and a Beat" singer received flack for starting a show two hours late, before collapsing on stage the next night.
He later lashed out at a paparazzo, yelling, "I'll f--king beat the f--k out of you!"
Justin Timberlake’s opening monologue was highlighted by the fact it was his fifth time hosting. That gave him access to the exclusive “five-timer's club.” Timberlake was taken off stage and into the "inner sanctum", where he found a bunch of SNL veterans who had all hosted or performed as the musical guest at least five times.
Paul Simon greeted Timberlake, so did Steve Martin. Dan Aykroyd was there, but since he was just a one-time host, he bartended for the clubmembers. Martin Short also isn’t a member of the club, so he worked as a waiter.
When Chevy Chase showed up and stood next to Short and Martin, Timberlake told the crowd he was standing next to the "three amigos". The amigos also showed up in full Mariachi outfits later in the show to introduce Timberlake’s second musical performance.
Alec Baldwin and Tom Hanks told JT their greatest pleasure of the five-timers club was making SNL castmembers fight each other.
Then, Candice Bergen showed up to demand the other members put the toilet seat down after using it.
In its cold open, SNL made fun of the death of Venezuelan president Hugo Chavez as Timberlake played Elton John and sang a parody of “Candle in the Wind".
The show also included Justin reuniting with Andy Samberg as their “Dick in a Box” characters during a dating sketch. Steve Martin and Dan Aykroyd competed against them as two wild and crazy guys.
Another skit featured Timberlake meeting a “cute brunette” at a grocery store and they fall in love. But they are soon torn apart by her secret—she has a penis.
The musical performance of "Suit And Tie" also featured an appearance from Jay-Z.
Rihanna told Elle U.K. that her mom got upset with her when she posted a few "racy" Instagram pics.
She said: "I'm not afraid of any person in this world but my mother, I'm terrified of her! She called me two days ago and reeled me in about two naked pictures my friend put up on Instagram, a sneak peek from a photo book she's making about me."
"She went crazy on me, I was like, embarrassed. I felt like I got my a-- whipped in front of my class at school! She humbled the f--k out of me."
Adele will be singing for Michelle Obama during her 50th birthday party at the White House. She'll join Beyonce at the party on January 17th of next year.
Mrs. Obama will be holding a huge celebrity-packed party for her birthday at the White House and since she loves Adele and Beyonce, she has asked them both to sing.
A source told the UK's Daily Mail: "Adele has graciously accepted and waived her usual fee for the high-profile private performance. She will sing a selection of her most-loved hits for the First Lady and her friends. The Obamas will pay Adele’s expenses as it’s a private party, not a State one."

Bieber made headlines in the UK last week after he hit the stage in London two hours late. Then, he collapsed during another show.
Noel said: "Is it rock ‘n’ roll to be two hours late? It depends on what he was doing in those two hours. Was he snorting coke off prostitutes? Or was he playing bridge? That’s not very rock'n'roll, is it? My cat sounds more rock ’n’ roll that that. I just know his name — Justin. Whatever. I don’t know anything about him. Taylor Swift announced that on Wednesday, Diet Coke’s Facebook page will debut a video series about her life on tour.
Reps for One Direction said the band has been forced to delete a social media request for fans to submit footage of their "real tattoos" of the group.
The band was offering those who submitted the footage a chance of appearing in their upcoming film.
The band tweeted: "Have a real #1D tattoo? Show us! Submit a 90 sec YouTube video to firstname.lastname@example.org and show us why you should be in the @1D3Dmovie!"
The latest message said, "This tweet was posted in error and has now been removed. One Direction does not want to encourage any of their fans to get 1D tattoos."
Many people objected to the request that was posted on Facebook and Twitter, because many of the band’s fans are under the age of 18.

Rod Stewart said you probably won't ever see his wife Penny Lancaster on the "Real Housewives of Beverly Hills" next season because she officially turned it down!
Penny was one of the front-runners to replace Adrienne Maloof and Camille Grammer, but Rod says his wife killed the negotiations.
He said: "She doesn't want to do that sort of thing. She's just happy being a mom."
Rick Springfield was arrested at his home in Los Angeles for missing a court date for a past DUI bust.
One Springfield got to jail, he called his wife, who brought over paperwork that helped clear up the issue. In the end, he wasn’t charged.
Later on, Springfield went on his Facebook page and wrote: "My home away from home. Arrested this am on a bench warrant. I didn't know that I was supposed appear in court a few weeks ago. It was to do with the old DUI charge and it's been cleared up and I am free to go. Thought I might miss the gig but I will be there and we will celebrate together. Life is not boring. XOXO."
Brian Wilson announced details of two live shows he'll play with fellow Beach Boys Al Jardine and David Marks.
The announcement of the live date came after the group fell out with fellow members Mike Love and Bruce Johnston last year. The falling out happened when Mike and Bruce revealed plans to continue playing live under The Beach Boys name, with or without Wilson, Jardine and Marks.
So Brian, Al and David have announced shows in Ohio and a festival in Illinois in July.
