Gabriel Aubry was granted a temporary restraining order against Halle Berry's fiancé Olivier Martinez-- who he says threatened to kill him during a Thanksgiving brawl.
According to Aubry, Martinez jumped off the stairs and knocked him to the ground and started brutally beating him, screaming that Gabriel cost them $3 million to fight the custody war.
Gabriel says Olivier took his head in his hand and slammed it on the concrete driveway.
And as Olivier assaulted Gabriel he screamed that they were going to move to Paris and Gabriel had better move there too or Olivier would kill him.

Gabriel Aubry could be deported back to Canada because of his arrest after his fight with Halle Berry's fiancé Olivier Martinez.
Sources say that Aubry in the US on a work visa and anytime someone is arrested on child abuse, domestic violence, assault or battery charges the Immigration and Naturalization Services is contacted by law enforcement.
Allegedly, there is a chance that the visa can be terminated and he can be deported because of the arrest and he doesn’t even need to be convicted.
Charlie Sheen says he donated his “Scary Movie 5” paycheck to Lindsay Lohan and three different charities.
Sources close to Sheen claim that he was paid $250,000 to show up for one day of shooting for the "Scary Movie" series, and decided to donate the cash.
Aside from the $100,000 that he reportedly gave Lindsay Lohan to help out with her tax bill, he donated the rest to three charities that were chosen by the movie's director, producer, and one of the other filmmakers behind the film.
Lindsay Lohan was devastated after being slammed on Twitter for her performance as Elizabeth Taylor in “Liz & Dick.”
The movie aired on Sunday night on Lifetime.
A producer of ABC's “The Bachelor” tweeted “Lindsay Lohan breaks new ground and shows her versatility in Liz and Dick by playing a chain-smoking emotional wreck pill-popping alcoholic.”

A source claims, "Lindsay has asked her manager and agent to look into getting her her own television sitcom.

Lindsay feels most comfortable doing comedy and it was Charlie Sheen that told her she should do it. Charlie told Lindsay that it was an easy way to make very good money and help her to get her movie career back on track. NBA star Kris Humphries likes the Kim Kardashian 'type'.
Humphries bought galpal Myla Sinanaj a boob job to make her look even more like his wife of 72-days, Kardashian.
A source claims, “Kris paid for Myla’s boob job because he’s trying to turn her into Kim Kardashian. No one knows she got a boob job, but she went from a B cup to a D cup.”
BTW: Humphries and Kardashian have yet to finalize their divorce.

Simon Cowell is the latest “swatting” victim in L.A., where someone makes a prank call that brings out the authorities for a fake emergency.
Someone called 911 on Sunday and reported that the "X Factor" judge was duct taped in his home and being held hostage.
The female caller claimed Simon was bound and gagged in the bathroom of his Beverly Hills estate.
Police responded but found nothing.
Simon was at home at the time.
Other recent “swatting” victims include Ashton Kutcher, Miley Cyrus and Justin Bieber.
Dolly Parton is not gay.
During an interview with "Nightline", the country music legend says she's well aware of the rumors that she's in a secret relationship with best friend Judy Ogle.
Dolly explained: "Judy and I have been best friends since we were like in the third and fourth grade. We still just have a great friendship and relationship and I love her as much as I love anybody in the whole world, but we're not romantically involved."
Dolly has been married to a man for 46 years and says she bonded with Oprah Winfrey over the lesbian rumors; Oprah has also been hounded by false rumors that she's in a secret relationship with her pal Gayle King.
Dolly says, "Like Gayle, her friend, Judy, my friend ... [people] just think that you just can't be that close to somebody."

Eddie Cibrian, Amy Smart, Terry Crews and Nia Long have joined the cast of Tyler Perry’s latest movie project, Tyler Perry’s "Single Moms Club".
Perry wrote the script and is directing the comedy, which started production Monday. Lionsgate will release the movie theatrically on May 9, 2014.
The plot follows a group of single mothers from different walks of life who bond after an incident at their children’s school and create a support group.
“Two and A Half Men” star Angus T Jones has found God, and blasted his hit show for its “filth”.
The 19-year-old who makes $350,000 per episode playing Jake is featured in a new video for the Forerunner Chronicles Church.
In it he says: 'If you watch Two and a Half Men, please stop watching. I'm on Two and a Half Men and I don't want to be on it.'
“Please stop watching it and filling your head with filth. People say it’s just entertainment.”
He adds, “You cannot be a true God-fearing person and be on a television show like that. I know I can't.”
Warner Brothers had not commented on the video, but his comments could be breach of his contract since most have clauses that ban actors from talking negatively about the show.
"Exploited by the Church"
Angus T Jones' mom feels he’s being exploited by the church that put out his video.
Carey Jones says she was worried for her son. She says, “I'm concerned he's being exploited by the church” but she refused to comment further.
There are also concerns that the church that put out the video, the Forerunner Chronicles is a cult.

Steven Tyler was asked about the upcoming season of "American Idol" and slammed the new crop of judges—Mariah Carey, Nicki Minaj and Keith Urban.
The Aerosmith frontman, and former 'Idol' judge, said: "I know that they've got something going on on the judges' panel, and it shouldn't be that, it should be just the opposite. They should have something going on, which is called 'camaraderie.' They should have something going on so thick and beautiful that they can lay it over the new talent that's trying to birth itself. It needs to be birthed, not judged by 'entertainment' factors, it needs to be judged by people that are honest, true, that have the 'it' factor. Not the 'it' factor because they can fight. The f--- is that all about?"
Tyler used last year's "Idol" champ, Phillip Phillips, as an example of the type of artist that "camaraderie" is capable of creating. He hopes Minaj and Carey can put aside their differences.
He said: "You just have to give your opinion. It wasn't hard for me, but I would imagine it's hard for some people, and they need a manager to say 'Shut the f--- up, and just give them your opinion.' These kids, they just got out of a car from the Midwest somewhere and they're in New York City, they're scared to death; you're not going to get the best out of them. If it was Bob Dylan, Nicki Minaj would have had him sent to the cornfield! Whereas, if it was Bob Dylan with us, we would have brought the best of him out, as we did with Phillip Phillips. Just saying."

Nicki Minaj says it’s “racist” of Steven Tyler to predict that she’d probably send Bob Dylan back to “the cornfield” if he appeared as a contestant on the Fox show.
Minaj tweeted: “You assume that I wouldn’t have liked Bob Dylan??? why? black? rapper? what? go f--k yourself and worry about yourself babe.
'I understand you really wanted to keep your job but take that up with the producers. I haven’t done anything to you. That’s a racist comment.'

Carly Rae Jepsen and Neon Trees have been added to ABC’s “Dick Clark’s New Year’s Rockin’ Eve,” hosted by Ryan Seacrest.
Jepsen, Taylor Swift and Neon Trees will perform in Times Square, while Brandy, Flo Rida, Karmin, OneRepublic and Pitbull are in LA.
Also added to the show is a two-hour tribute to the late Dick Clark, which will air from 8 to 10 p.m. that night and will be hosted by Fergie and Jenny McCarthy(who’ll be joined by Seacrest). It will include clips and reminiscences of Clark, who passed away last April at the age of 82.
More artists are expected to be announced in the coming weeks.
Cee Lo Green will be guest starring on an episode of Charlie Sheen's series "Anger Management" in its second season.
The episode is called "Charlie and Cee Lo," and will feature Cee Lo as himself coming to Charlie for help.
He will play "the nicest guy in show business" who is afraid the pressure of the entertainment world will cause him to lash out at the people around him, so he goes to Charlie to help him control his anger.
** This isn't the first time Cee Lo acted on TV as himself. He appeared on season three of NBC's "Parenthood" and also lent his voice and image to Fox's "American Dad!"
Ben Savage and Danielle Fishel have officially signed on to reprise their roles as Cory Matthews and Topanga Lawrence in the Disney Channel pilot "Girl Meets World", the follow-up to "Boy Meets World".
The sequel would pick up more than a decade after "Boy Meets World" ended its ABC run . Cory and Topanga are happily married and raising their 13-year-old daughter, Riley (from whose point of view the story is told).
The pilot is still in the very early stages of development.
A nationwide casting search is underway for the role of Riley.

And now pals claim the musical couple is planning to move in together within weeks.
They are quietly house-hunting in Los Angeles and hope to be in a new rented pad around Christmas time.
A source said: “John and Katy have decided to give it a proper go and want to find a place in LA to share.
“But lots of people are willing them to fail. They argue a lot and have quite a turbulent up-and-down relationship, despite it only being a few months old.
“Many of her friends are certain it will all end in tears.
“But that’s brought them closer in a way. It’s given them an ‘us against the world’ mentality.”
Don't mess with Texan Kelly Clarkson.
The original "American Idol" is furious that a magazine in the United Kingdom has misquoted her.
Kelly responded to a cover story in the UK Mirror Sunday Celebs insert, which featured a photo of Clarkson with a headline that read: "No one on the planet should be as famous as me."
Kelly tweeted: "I love when people take what you say and twist it to make you sound obnoxious and arrogant."
The publication also positioned Clarkson as having revealed that she had anorexia, which she denied.
Kelly wrote: "I have never had anorexia nor did I ever say 'no one should be as famous as me'.
"I said in the interview, when asked about fame, that I have no desire to be as famous as Britney [Spears] or Madonna. I said that kind of fame was too much for any person and that I have experienced a portion of what they deal with and that I didn't handle that well and I'm happy where I'm at in my career. ... nice job Mirror."

HBO announced that a documentary about Beyonce will debut February 16th, 2013. Beyonce is also directing the film, which will include footage she shot herself with her laptop.
HBO said the documentary will include "video that provides raw, unprecedented access to the private entertainment icon and high-voltage performances."
It will also feature home videos of her family and of Beyonce as a new mother and owner of her company, Parkwood Entertainment.
Beyonce said the untitled project is "personal" to her.
She is also set to perform at the 2013 Super Bowl halftime show on February 3rd, about two weeks before the documentary airs.
Justin Bieber was criticized for what he wore to accept an award from his nation's prime minister.
Justin wore blue and white striped overalls over a white T-shirt, with a dark-colored backwards baseball cap. He finished the outfit off with a large silver chain around his neck and bright yellow sneakers.
Justin was there to receive a Diamond Jubilee Medal, which honors significant achievements by Canadians.
After pics of Justin came out, some media outlets called him the "White Trash Prince."
Justin also Tweeted: "I met the Prime Minister in overalls lol. I hope you hate my style."
Bieber also defended himself by saying the picture was taken in an arena where he was performing the day he got the award.

Simon Cowell criticized Martin Gore after the Depeche Mode guitarist said he wanted to "shoot" him.
In an interview last week, Gore admitted that he hates reality TV shows, "X Factor" and that Cowell should be shot since he created the show.
Cowell said that comments like that encourage real-life shootings.
He wrote: "I read Martin Gore wants to shoot me. He was in Depeche Mode. Do you realize how weird and stupid that makes you. Go and watch the news. Why I am angry about weirdo Gore is a ton of people have got shot this year and people like weirdo Gore encourage this."
No comment from Gore or his camp.
Ashlee Simpson and her boyfriend, “Boardwalk Empire” star Vincent Piazza, have split after nearly 1 1/2 years of dating.
They broke up over the Thanksgiving holiday.
A source tells the NY Post, “Vincent has been working a lot, so he hasn’t been able to spend as much time with Ashlee, which has caused some problems. It was a mutual agreement to split, but things have been bumpy for a little while, so perhaps they might reconcile.”
Simpson began dating Piazza in June 2011, after splitting with Pete Wentz, the father of her 3-year-old son, Bronx.
